Posting Terms

These Opportunity Board Posting Terms ("Posting Terms") govern the purchase, submission, review, publication, maintenance, and removal of opportunity listings on the Workroom Opportunity Board.

These Posting Terms are between the organization or individual purchasing or submitting a posting ("Posting Organization," "you," or "your") and The Workroom Consulting Group, LLC ("The Workroom," "we," "our," or "us").

By purchasing or submitting an Opportunity Board listing, you agree to these Posting Terms and the general Terms & Conditions and acknowledge the Privacy Policy.

The Opportunity Board

The Opportunity Board provides organizations with a platform to publish approved professional opportunities, including:

  • Employment opportunities

  • Consulting and project-based opportunities

  • Board service opportunities

  • Other professional opportunities expressly approved by The Workroom


Unless separately agreed in writing, purchasing or publishing an Opportunity Board listing does not engage The Workroom to recruit, source, screen, interview, evaluate, recommend, select, or hire candidates.

The Workroom does not become the employer, contractor, recruiter, employment agent, or representative of the Posting Organization or any individual who responds to a listing.

Accuracy and Responsibility for Posting Content

The Posting Organization is solely responsible for the substantive content of its listing.


You represent and warrant that information supplied to The Workroom is accurate, complete, current, and not misleading, including information relating to:

  • Opportunity title and responsibilities

  • Employment or engagement type

  • Compensation or stipend

  • Benefits

  • Work arrangement

  • Location

  • Estimated time commitment

  • Required and preferred qualifications

  • Application materials

  • Interview or selection process

  • Hiring or selection timeline

  • Application deadline

  • Board responsibilities

  • Fundraising or financial expectations

  • Application links and contact information


You agree to promptly notify The Workroom if an opportunity is filled, withdrawn, materially changed, or otherwise becomes inaccurate.

The Posting Organization remains responsible for reviewing its published listing and informing The Workroom of substantive errors or requested corrections.

Compliance With Law

The Posting Organization is solely responsible for ensuring that its posting, recruiting practices, selection process, employment practices, contracting practices, and board-selection practices comply with applicable federal, state, and local laws.

This includes, as applicable, laws relating to:

  • Equal employment opportunity and nondiscrimination

  • Wages and compensation

  • Employment classification

  • Independent contractors

  • Worker classification

  • Accessibility

  • Applicant privacy

  • Background checks

  • Employment authorization

  • Tax obligations

  • Board governance and fiduciary duties


Publication by The Workroom does not constitute legal review or confirmation that a posting or hiring practice complies with applicable law.

Materials and Intellectual Property

The Posting Organization retains ownership of the materials it submits.

By submitting content for publication, you grant The Workroom a non-exclusive, royalty-free license during the applicable posting and promotional period to use, reproduce, format, display, distribute, and reasonably promote the organization name, logo, posting content, job description, and other non-confidential materials supplied for publication.


This license is limited to operating, displaying, administering, and promoting the Opportunity Board and the applicable opportunity.

You represent and warrant that materials provided to The Workroom do not infringe any third-party intellectual property, privacy, contractual, confidentiality, or other rights.

Review and Publication

Submission and payment do not guarantee publication.

The Workroom may review submissions for compliance with these Posting Terms, Opportunity Board standards, completeness, clarity, transparency, safety, and platform fit.


The Workroom may, in its reasonable discretion:

  • Approve a submission

  • Decline a submission

  • Request additional information

  • Require revisions before publication

  • Correct formatting, spacing, typographical errors, or display issues

  • Delay publication pending clarification

  • Suspend or remove a published listing

  • Decline future submissions from an organization that repeatedly violates these Posting Terms

The Workroom will not knowingly make a substantive change to a Posting Organization's opportunity without authorization.

Publication does not constitute endorsement, verification, certification, or recommendation of the Posting Organization or opportunity.

Prohibited Postings

The following may not be submitted or published:

  • Fraudulent, false, deceptive, misleading, or nonexistent opportunities

  • Opportunities submitted without authorization from the organization represented

  • Postings containing unlawful discriminatory requirements or preferences

  • Opportunities involving unlawful activity

  • Opportunities materially misrepresenting compensation, responsibilities, organizational identity, location, work arrangement, or engagement terms

  • Pyramid schemes or deceptive multi-level marketing arrangements

  • Postings primarily intended to recruit additional scheme participants rather than fill a bona fide opportunity

  • Opportunities requiring employment or consulting applicants to pay money, purchase goods or services, or provide financial consideration as a condition of consideration, except lawful and clearly disclosed expectations associated with board service

  • Postings primarily intended to collect personal information rather than fill a legitimate opportunity

  • Malicious links, malware, phishing attempts, or deceptive redirects

  • Content that infringes intellectual property, confidentiality, privacy, or other legal rights

  • Opportunities or content The Workroom reasonably believes may expose users, organizations, or the platform to fraud, harm, or material legal risk

The Workroom may immediately suspend or remove prohibited content.

Posting Fees and Payment

Posting fees are charged at the price presented at the time of purchase.

Prices, promotional rates, multi-post packages, discounts, and other offers may change for future purchases.

Payment is required before publication unless The Workroom expressly agrees otherwise in writing.

The posting fee covers review and publication of the opportunity and access to the features expressly included with the purchased listing.

The standard posting fee does not include:

  • Recruiting

  • Candidate sourcing

  • Resume screening

  • Candidate evaluation

  • Compensation analysis

  • Job or role design

  • Organizational design

  • Interview development

  • Reference checks

  • Selection recommendations

  • Hiring advisory services

Any additional advisory or consulting services must be separately agreed upon.

Refund Policy

All Opportunity Board posting payments are non-refundable except in the event of a material breach by The Workroom or where otherwise required by law.

A refund will not be provided because:

  • The Posting Organization fills the opportunity before the listing period ends

  • The Posting Organization withdraws or cancels the opportunity

  • Hiring or selection plans change

  • The Posting Organization receives fewer views, clicks, inquiries, applications, or candidates than anticipated

  • The Posting Organization does not hire or select a candidate

  • A candidate withdraws

  • The Posting Organization fails to maintain its application link, email, or application system

  • A posting is removed because it violates these Posting Terms

  • The Posting Organization fails to provide information or corrections necessary to publish or maintain the listing


Duplicate or erroneous charges should be reported promptly.

If The Workroom declines to publish an otherwise compliant submission for reasons unrelated to a violation of these Posting Terms, The Workroom may issue a refund or posting credit.

Listing Duration and Removal

Unless a different duration is identified at purchase, an Opportunity Board listing may remain published for up to 60 days.

A listing may be removed sooner if:

  • The application deadline passes

  • The opportunity is filled, closed, or withdrawn

  • The Posting Organization requests removal

  • The listing becomes inaccurate or materially outdated

  • An application link becomes inactive or inaccessible

  • The Posting Organization violates these Posting Terms

  • Removal is reasonably necessary for legal, security, fraud-prevention, or platform reasons


Early removal does not ordinarily entitle the Posting Organization to a refund.

Renewal or republication following expiration of the listing period may require purchase of a new posting.

Candidate Applications and Applicant Information

Unless separately agreed in writing, The Workroom does not collect or administer applications on behalf of the Posting Organization.

The Posting Organization must provide an application destination, which may include:

  • Its own website

  • An applicant tracking system

  • Another third-party application platform

  • An organization-controlled email address


The Posting Organization is solely responsible for its application system and for information it receives from applicants.

The Posting Organization is responsible for appropriately collecting, storing, using, sharing, retaining, and protecting applicant information in accordance with applicable law and its own privacy practices.

The Workroom is not responsible for applicant information submitted directly to the Posting Organization or its third-party providers.

No Guarantee of Applicants or Outcomes

The Workroom does not guarantee:

  • A minimum number of listing views

  • A minimum number of clicks

  • A minimum number of applicants or inquiries

  • Any particular type or quality of candidate

  • Interviews

  • Offers

  • Accepted offers

  • Completed consulting engagements

  • Board appointments

  • Successful hires

  • Employee or contractor retention

  • Any other hiring, contracting, or governance outcome


The Posting Organization remains solely responsible for evaluating candidates and making employment, contracting, consulting, and board-selection decisions.

Employer and Organization Due Diligence

The Workroom does not independently verify candidate resumes, credentials, references, employment history, licenses, background information, representations, or qualifications.


The Posting Organization is responsible for conducting any screening, reference checking, credential verification, background checking, or other due diligence it considers appropriate and legally permissible.

Consulting and Project-Based Opportunities

Consulting and project-based postings may involve consultants, vendors, independent contractors, temporary professionals, or other non-employment relationships.

The Posting Organization is solely responsible for determining the correct legal classification of any individual or entity engaged through the opportunity.

The Posting Organization is also responsible for applicable compensation, tax, insurance, wage, benefit, contractor, and other obligations.

The Workroom's publication of a consulting or project opportunity does not constitute a determination or representation that the opportunity has been properly classified.

Board Service Opportunities 

Organizations posting board service opportunities are responsible for accurately disclosing material expectations associated with service, including, where applicable:

  • Expected time commitment

  • Term of service

  • Meeting schedule

  • Committee participation

  • Financial contribution expectations

  • Fundraising expectations

  • Fiduciary responsibilities

  • Other material obligations


Individuals considering board service are responsible for conducting their own due diligence regarding the organization and the responsibilities associated with the position.

Publication by The Workroom does not constitute governance, fiduciary, tax, financial, or legal advice.

Separate Advisory and Hiring Services

A Posting Organization may separately engage The Workroom for organizational, hiring, operational, compensation, role-design, interview, or other advisory services.

Those services are separate from an Opportunity Board listing and are governed by their own written scope, fees, and contractual terms.

Purchasing an Opportunity Board posting does not create a consulting engagement.

Limitation of Liability 

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WORKROOM SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM OR RELATING TO AN OPPORTUNITY BOARD POSTING.

THE WORKROOM'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO AN OPPORTUNITY BOARD PURCHASE OR POSTING, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE TOTAL AMOUNT OF OPPORTUNITY BOARD FEES ACTUALLY PAID BY THE POSTING ORGANIZATION TO THE WORKROOM DURING THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Posting Terms limits liability that cannot legally be limited.

Dispute Resolution

Except as otherwise agreed in writing, the parties will first attempt to resolve disputes arising from or relating to a paid Opportunity Board posting through good-faith communication.

If the dispute is not resolved, either party may request non-binding mediation in St. Louis, Missouri.

Any dispute remaining unresolved following mediation may be submitted to binding arbitration administered by the American Arbitration Association in St. Louis, Missouri, under its applicable commercial arbitration rules, unless applicable law provides otherwise.

Nothing in this section prevents either party from seeking immediate injunctive or other provisional relief when reasonably necessary to protect intellectual property, confidential information, payment rights, platform security, or other rights for which monetary damages would be inadequate.

This section should be read together with any rights or remedies that cannot lawfully be waived.

Governing Law

These Posting Terms are governed, construed, and interpreted in accordance with the laws of the State of Missouri, without regard to choice-of-law principles that would require application of another state's laws.

Severability

If any provision of these Posting Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

Changes to These Posting Terms

The Workroom may update these Posting Terms for future purchases and submissions.

The version in effect when a Posting Organization purchases a listing will govern that purchase unless applicable law requires otherwise.
